A Michigan judge has one business day to rule on a request for an emergency Personal Protection Order. Not a week. One business day. This deadline exists because danger in these cases usually happens now, and court rulings are written to match this.

That speed is also what makes these cases difficult. A PPO can be entered without the other person in the room on one written petition. This is exactly right if someone is being threatened and a serious problem if the petition is not true.

What a Michigan PPO Actually Restrains

A PPO is a civil order issued by the family division of the court. It restricts the respondent and only the respondent. It does not restrict you.

Depending on what the petition requests and what the judge decides, a PPO may prohibit the respondent from:

Contacting you by phone, text, email, or social media

Entering your home, workplace, or premises

Appearing in your vicinity, which includes a grocery store aisle and your driveway

Threatening, assaulting, wounding, or stalking you

Purchasing or possessing a firearm (which in many domestic situations federal law prohibits independently)

A PPO does not divide property, set child support, or decide custody. These issues are dealt with in the divorce and custody files, even if the same two people are involved in both cases.

The Three Types of PPOs, and Why Choosing Wrong Matters

Michigan recognizes three, and which one you file depends on your relationship with the respondent.

Domestic relationship PPOs are governed by MCL 600.2950. You qualify if the respondent is your spouse or former spouse, someone you share a child with, someone with whom you have or have had a dating relationship, or someone who lives or lived in your household. Roommates count.

Non-domestic stalking PPOs fall under MCL 600.2950a. This covers neighbors, coworkers, former friends, and strangers. The petition must allege facts that meet the Michigan definition of stalking: two or more unconsented contacts that would cause a reasonable person to feel terrorized, frightened, or harassed.

Non-domestic sexual assault PPOs also fall under MCL 600.2950a and are available regardless of the relationship between the respondent and the victim where the respondent has committed or threatened to commit sexual assault.

File under the wrong section, and the judge may deny the petition solely on that basis.

Filing for a PPO in Oakland County

Novi residents file with the Oakland County Circuit Court Family Division in Pontiac. There is no filing fee for a PPO petition in Michigan.

The petition is where these cases are won or lost. Judges read specific facts: dates, what was said, and what was sent. “He has been harassing me for months” gives the judge nothing to act on. A list of eleven text messages dated, two appearances at your workplace, and a threat made in front of a witness give the judge a record.

If you ask for an ex parte order, which means one entered before the respondent has been notified, the court must find that immediate and irreparable harm will result from delaying the notice or that the notice itself will cause the respondent to act. According to Court Rule MCR 3.705, a ruling must be made within one business day of filing. In practice, many petitioners in Oakland County receive an answer on the same day as their request.

An ex parte PPO is valid for at least 182 days and must state its expiration date on its face. It becomes enforceable the moment a judge signs it and the police can take action on it before formal service, provided that the respondent has received actual notice.

If the judge refuses to issue an order ex parte, this is not the end. You can ask for a full hearing, but you only have 21 days to do so. After that, the denial will be final.

If You Have Been Served With a PPO

You have 14 days from when you receive notice of an ex parte PPO or otherwise learn of one to file a motion to modify or terminate it. If you do not file within that time period, you will need to provide a good cause for your delay. Once the motion has been filed, the court will schedule a hearing within 14 days.

That hearing matters for one reason most respondents don’t know: the burden of proof shifts. At a hearing on a motion to terminate an ex parte PPO, the petitioner has to justify keeping it in place. You are not required to prove anything.

What you cannot do is to decide that the order is unfair and act accordingly. A decision you believe was made through lies is fully enforceable until a judge decides otherwise. One text, one appearance at a child’s soccer game, and the question becomes whether the PPO was justified or whether you violated it.

Where PPOs Collide With Divorce and Custody

A PPO can reshape a family law case in a single afternoon. Parenting time gets suspended or moved to supervised exchanges. One parent leaves the marital home. Michigan judges weigh domestic violence when applying best interests factors, so a PPO entered during a divorce or paternity case rarely stays confined to the protection file.

That cuts both ways. For a parent who is genuinely threatened, the PPO makes safe parenting possible. For parents facing a petition filed for leverage during a custody fight, the same order can quietly turn a temporary arrangement into a permanent one. These are common in Oakland County.

Violations, Enforcement, and Expiration

Once the PPO has been issued, it is entered into the Law Enforcement Information Network, and any officer in Michigan can access it. Under MCL 764.15b, the police may arrest a person who violates a PPO without a warrant. A person 18 years or older who is found guilty of violating a PPO faces up to 93 days in jail and a fine of up to $500, according to Michigan law. Michigan PPOs are enforceable in all other states.

If violations continue, you can file a motion for a show-cause hearing. Document everything first. Take screenshots with visible timestamps, include call logs, voicemails, and the names of anyone who witnessed what happened.

One deadline that catches people every year: a motion to extend a PPO must be filed at least three days before the order expires. If you miss it, you will have to start over with a new petition and new facts.
